Legal Pre-existing  Structure 75 Feet Or Greater to OHWM-Not meeting Class Setback

Langlade County Ordinance

If all of your principal structure is at least 75 feet from the OHWM, but less than what the waterway classification regulations require, ordinary maintenance and repair and expansion is allowed provided that:

bullet Expansion. Expansion is limited to 2,250 square feet of total footprint (total of existing and proposed construction). (Click Here)
bullet Location of Expansion. Any addition shall be located on the landward side of the structure or in compliance with the required setback; if it is not feasible because of limiting site or existing structural conditions to place and addition on the landward side of an existing structure or in compliance with the setback, an addition may be located no closer to the water than the existing structure, provided it is set back as far as practicable.
bullet Walls. The total length of existing external walls modified or replaced over the life of the structure does not exceed 25% of the total original perimeter of the structure.
bullet Basements. New basements are allowed only where it is not possible due to limited lot size, steep slopes, or high-quality natural features to move the structure back from the water in compliance with county relocation standards. (Click Here) Expansion of an existing basement is permitted.
bullet Expansion of second Stories. Expansion of existing second stories is permitted where such expansion complies with limitations on total footprint, does not exceed the existing structure's height, does not exceed 35 feet in height, and is, if practicable, located on the landward side of the structure in compliance with the required setback.
bullet New second stories. Additions of new second stories that comply with limitations on total footprint with a maximum height of 35 feet are permitted.
bullet Roofs. Replacement of roofs as allowed under ordinary maintenance and repair is permitted with a maximum height of 35 feet; a conditional use permit is needed for a proposed roof replacement that does not meet these requirements.
bullet Lot coverage. Limitations on lot coverage and land disturbing activities are observed.
bullet Mitigation.  Mitigation requirements are implemented except for projects involving only ordinary maintenance and repair.. (Click Here)
